Social assistance

Social assistance should enable the recipient to lead a life that is in keeping with human dignity. If possible, the assistance should enable them to live independently in the future.

General information:

Until December 31, 2004, social assistance was granted in accordance with the Federal Social Assistance Act. From January 1, 2005, the law on social assistance was regulated in accordance with the Social Code - Twelfth Book (SGB XII) of December 27, 2003 (BGBl. Part I, page 3022/3023).

In the event of current emergencies, assistance can be granted in accordance with the provisions of SGB XII, whereby it is the task of social assistance to enable the recipient of the benefit to lead a life that is in keeping with human dignity. The assistance should enable them to live independently as far as possible. The beneficiary must cooperate in this to the best of their ability.

Social welfare benefits are:

  • Assistance with living expenses (Chapter 3 SGB XII)
    (3rd chapter SGB XII)
  • Basic income support in old age and in the event of reduced earning capacity (Chapter 4 SGB XII)
  • Health assistance (5th chapter of SGB XII)
  • Integration assistance for disabled people (6th chapter of SGB XII)
  • Care assistance (7th chapter of SGB XII)
  • Help to overcome particular social difficulties (8th chapter of SGB XII)
  • Assistance in other life situations such as help with running a household, assistance for the elderly, assistance for the blind and funeral costs (9th chapter of SGB XII) and
  • the advice and support required in each case

The benefits are provided as a service, cash benefit or benefit in kind. Services include, in particular, advice on social welfare issues and support in other social matters. Personal assistance is provided by the social service.

Assistance with living expenses

Persons who have reached the age of 65 or have reached the age of 18 and are permanently unable to work, i.e. can no longer work for at least 3 hours a day, are entitled to basic income support in old age and in the event of reduced earning capacity in accordance with Chapter 4 of SGB XII if they are in need. This benefit takes precedence over subsistence assistance under Chapter 3.

This means that people who receive a temporary disability pension, for example, are still entitled to benefits.

Assistance with living expenses covers the necessary means of subsistence. This consists in particular of food, accommodation, clothing, personal hygiene, household effects, heating and personal everyday needs. All necessary living expenses, with the exception of benefits for accommodation and heating and specially regulated special needs, are paid according to standard rates.
