Certain structures and parts of structures may be erected, incorporated into structures, or modified as construction projects not subject to a permit and without notification. These construction projects are listed in the appendix to Section 60(1) of the Lower Saxony Building Code (NBauO).

Pursuant to Section 60(2) of the Lower Saxony Building Code (NBauO), construction projects exempt from the permitting process also include:

• a change in the use of a structure, provided that public building law imposes neither different nor more extensive requirements on the new use, or the construction or alteration of the structure would be exempt from the permit process under paragraph 1,
• the conversion of rooms in the attic of a residential building containing only one apartment into living spaces belonging to that apartment,
• the conversion of rooms in existing residential buildings and apartments into rooms with a bathtub or shower or with a toilet,
• the demolition and removal of structures, with the exception of high-rise buildings, and of the parts of structures listed in the appendix,
• the maintenance of structures.

If there is any doubt as to whether a proposed construction project requires a permit or notification, information may be obtained from the competent authority before the project is carried out.
