Advance on maintenance

Payment of maintenance costs for a child of a parent living alone if the parent liable for maintenance does not meet their maintenance obligation.

When do I receive maintenance advance?

Advance maintenance payments are granted up to the age of 12 and, under certain conditions, up to the age of 18.

If you are bringing up your child alone, you are often faced with many challenges. If the other parent does not pay at least the amount of maintenance to be granted in advance (see information sheet) or you receive less half-orphan's pension, you are basically entitled to advance maintenance payments.

Your child is entitled to advance maintenance payments if:

  • is resident or habitually resident in Germany,
  • they live with a single parent who is single, widowed, divorced or permanently separated from their spouse,
  • the orphan's income after the death of the other parent is not at least equivalent to the advance maintenance payment (see information sheet)
  • the other parent has been in an institution (e.g. prison, clinic) for more than 6 months
  • the child has not yet reached the age of 18.

When is my entitlement excluded?

The entitlement is excluded if, among other things

  • both parents live together,
  • both parents live separately but look after and care for the child together,
  • the parent with whom the child lives marries (even if it is not the child's other parent) or
  • you refuse, for example, to provide information about the parent liable for maintenance or to cooperate in establishing paternity or the whereabouts of the other parent.
