Immission control

Immission control is the protection of the general public or individuals from air pollution, noise, vibrations and similar environmental hazards.

Immission control

Immission control refers to the protection of humans, animals, plants and the environment from harmful environmental impacts caused by plants or certain activities. This can include air pollution, noise, vibrations and similar environmental hazards. The legal basis is provided by the Federal Immission Control Act (BImSchG) and the associated implementing ordinances.

Notification and reporting obligations

Plant register 44th BImSchV

Newly erected and existing combustion plants with a rated thermal input of 1 megawatt to 50 megawatts must be notified to the competent authority. This obligation is based on Section 6 of the Ordinance on Medium-Sized Combustion, Gas Turbine and Internal Combustion Engine Plants (44th BImSchV).

This applies to the following installations, among others:

  • Boilers in larger buildings
  • Combined heat and power plants
  • Industrial combustion plants
  • Emergency power generators (diesel engines)
  • Gas turbine plants
  • Biomass plants

The notification can be made in writing or electronically. To ensure that the notification contains all relevant information, a table from the Lower Saxony Trade Inspectorate can be used as a guide. In accordance with § 36 Para. 1 of the 44th BImSchV, the city of Salzgitter, as the responsible authority, must keep and publish a register of the combustion plants to be registered in accordance with § 6. To date, however, no such installations have been registered in the area of responsibility of the City of Salzgitter.

Depending on the type of installation, further notification and reporting obligations may apply. Operators should therefore contact the responsible authority at an early stage.
