Approval practice for flea markets
Theprerequisite for such an exemption is that
1. there is an interval of approximately one month between the market events at the same location or in the same district,
2. only goods that are not new goods or that have been produced by the vendors themselves are offered at these events, and
3. at least 75 percent of the vendors are not commercial vendors.
Applications for exemptions must be submitted by November 30 for the following calendar year. If there are more applications for exemptions than the actual number of events possible, a balanced allocation will be made. If the applications are not received until the current year, the earliest application will be allocated. If this application contains fewer than the possible total number of 12 events per district (locality), further applications will be approved (according to the time of receipt) until the maximum number is reached.
You can apply informally for a necessary exemption permit with your market determination.
The so-called village flea markets do not fall under this procedure. They are already permitted under the NFeiertagsG, provided they are not organized commercially, are held exclusively for non-commercial vendors and serve charitable purposes.
