If someone is found to be carrying such weapons without a permit, this is a criminal offense. There is a risk of a prison sentence of up to 3 years and confiscation of the weapon. However, shooting in public is prohibited - except in self-defense - even with a "small firearms license". This also applies on New Year's Eve! There are only exceptions in a few individual cases, e.g. for theater or film performances or as a starting signal at sporting events. Violations are punishable as administrative offenses with fines of up to 5,000 euros.

Gas, signal and alarm weapons without a PTB mark are still subject to the obligation to hold a gun permit and firearms license. The small firearms license is to be issued for the category of alarm, irritant and signal weapons for an unlimited period and without express restriction to certain occasions or areas.

The ban on carrying weapons at public events remains unaffected.
