New Federal Registration Act

On November 1, 2015, the new Federal Registration Act comes into force throughout Germany. This will result in some significant changes for all citizens.

In future, it will regulate, among other things, the way in which data is stored, reporting obligations and also information from the register of residents or data transfers between public bodies.

The previous laws of the federal states will expire on this date. According to the Federal Ministry of the Interior, there will be some significant changes for citizens.

Information from the population register will be partially restricted

Insofar as information is requested from the registration authority for the purpose of advertising and address trading, this registration data will only be transmitted if the citizen concerned agrees to the transmission of their registration data for this purpose.

There is also a further restriction for requests for commercial purposes. In future, the purpose of the request must be stated for such requests and the requesters may only use the transmitted registration data for the purpose for which they have requested the registration data. As a result, citizens' registration data will generally be more protected than before.

Abolition of the obligation to register in hospitals

The obligation to register in hospitals and similar institutions will be completely abolished, so that no registration with the registration authority is required even for longer stays.

Obligation of the landlord to cooperate

Another significant change to the Federal Registration Act is the reintroduction of the landlord's obligation to cooperate. Currently, moving into a new home must be reported to the registration authority within one week of moving in. From 01.11.2015, the person obliged to register will be given two weeks to register their place of residence.

In connection with the registration of a residence, the person obliged to register must then submit, among other things, the landlord's confirmation of residence. Presentation of the tenancy agreement is not sufficient for this. From 01.11.2015, the landlord must therefore hand over the landlord's confirmation of residence to the person subject to registration within two weeks of moving in or send it electronically to the registration authority so that the landlord can comply with their legal obligation.

If the person subject to the registration obligation moves into their own home, a self-declaration must be submitted at the Citizens' Center during the registration process. The legislator's main aim is to counteract bogus registrations, i.e. registrations without the knowledge of the landlord.

Online access by security authorities

Security authorities and other authorities to be determined by other legislation are given online access to the registration data around the clock across all federal states.
