What is the legal basis for the wastewater contribution?
According to § 6 and § 6a of the Lower Saxony Municipal Fees Act (NKAG), the city can levy wastewater contributions.
Based on this provision, the city council has issued the wastewater disposal fee statutes. The statutes currently apply in the version of the new publication dated 25.04.2018, last amended by the 27th statute amending the statutes on charges and cost reimbursements for wastewater disposal in the city of Salzgitter dated 18.12.2019 (Amtsblatt für die Stadt Salzgitter No. 27 dated 30.12.2019)
What are wastewater contributions payable for?
Wastewater contributions are payable to cover the cost of constructing the central public wastewater facilities for the disposal of wastewater and rainwater.
What proportion of the costs are to be borne by the residents?
In accordance with Section 5 (1) of the wastewater disposal fee regulations, the contribution rates for the construction of the central public wastewater facilities for
a) Wastewater disposal 2.58 €/m2 of contributory area,
b) rainwater disposal 6.62 €/m2 of contributory area.
In the case of combined wastewater disposal, the contribution rates apply in parallel.
What scale is used to calculate the wastewater contribution?
The wastewater contribution is calculated according to a usage-based scale.
To determine the contributory area for calculating the wastewater contribution for wastewater disposal, the size of the property (area) is multiplied by a usage factor that depends on the number of full storeys permitted on the property.
To determine the contributory area for calculating the wastewater contribution for rainwater disposal, the plot size (area) is multiplied by the floor area ratio. The floor area ratio indicates how many square meters of floor area are permitted per square meter of plot area.
The stipulations made in a development plan are initially decisive for determining the number of permitted full storeys and the floor area ratio. The exact details of the distribution regulations are set out in § 4 of the wastewater disposal fee regulations.
The wastewater contribution is calculated by multiplying the determined areas subject to contributions by the contribution rates stipulated in the wastewater disposal levy statutes.
When does the obligation to pay contributions arise?
The obligation to pay contributions applies to properties that can be connected to a central public sewage system and for which
a) a building or commercial use is specified as soon as they may be used for building or commercial purposes,
b) a building or commercial use has not been determined, if they are building land according to the traffic conception and according to the orderly structural development of the city are to be built on or used for commercial purposes.
In the event of an actual connection to the central public sewage system, a property is also subject to the obligation to pay a contribution if the conditions described above are not met.
Who is liable to pay contributions?
The person liable to pay the contribution is the owner of the property subject to the contribution obligation at the time of notification of the contribution notice. If the property is encumbered with a heritable building right, the heritable building right holder is liable to pay the contribution instead of the owner. Several persons liable to pay contributions (e.g. spouses) may be held jointly and severally liable; however, apartment and part owners are only liable to pay contributions in proportion to their co-ownership share.
The city cannot take into account any private-law regulations deviating from this (e.g. in purchase contracts).
When is the wastewater contribution due?
The wastewater contribution is due one month after notification of the contribution notice. To avoid undue hardship, the city may allow the wastewater contribution to be deferred or paid in installments.
