For the following types of businesses, the business licensing authority must verify the business owner’s good character immediately after the business registration or re-registration is filed:

• Purchase and sale (secondhand goods trade) of
  • high-value consumer goods, in particular consumer electronics, computers, cameras, video cameras, carpets, and fur and leather clothing
  • motor vehicles and bicycles
  • precious metals and alloys containing precious metals, or goods made thereof
  • gemstones, pearls, and jewelry
  • Scrap metal
• Credit reporting agencies, private investigation agencies
• Matchmaking services for marriages, partnerships, and dating
• Operation of travel agencies and accommodation services
• Locksmith services; sale and installation of building security systems
• Manufacture and sale of specialized theft-related lock-picking tools

To this end, you must apply immediately after filing your business registration for a certificate of good conduct to be submitted to a government agency and an extract from the Central Business Register to be submitted to a government agency.

• Certificate of Good Conduct pursuant to Section 30(5) of the Federal Central Register Act (BZRG) for submission to a government agency (Leika code: 99049001001002):
• If the business operator is a natural person, a certificate of good conduct must be requested for submission to a government agency.
• In the case of partnerships, a certificate of good conduct must be requested for each managing partner for submission to a government agency.
• In the case of legal entities, a certificate of good conduct for submission to a government agency must be requested for each legal representative.
• Extract from the Central Trade Register pursuant to Section 150(5) of the Trade Regulation Act (GewO) for submission to a government agency (Leika key: 99052002109000):
• If the business operator is a natural person, an extract from the Central Trade Register must be requested for submission to a government agency.
• For partnerships, an extract from the Central Trade Register must be requested for each managing partner for submission to a government agency.
• For legal entities, a certificate of good conduct must be requested from each legal representative for submission to a government agency.
