Are/is

  • the custodial parent(s),
  • a parent with sole custody or
  • a person with guardianship rights

are legally or actually prevented from performing individual tasks for a child you/they represent, or if they are unable or unwilling to perform the necessary tasks, a guardianship can be set up by the local court for specific areas of responsibility. Some examples are listed below:

  • Personal care
  • Property care
  • Health care
  • Right of residence
  • Representation in criminal proceedings

Guardianship is not a public "service" in the narrower sense.
The inclusion of guardianship in Social Code VIII as an "other task" obliges the responsible authorities to have staff available to manage guardianships.

The management of a guardianship itself can be assigned to a specific person, an association or a youth welfare office. The local court decides to whom the guardianship is assigned.

The actual management of a guardianship is governed by private law. The persons who manage the guardianship fulfill all tasks for their area of responsibility that would have to be carried out by the parents without this guardianship.

If a guardianship is managed by a youth welfare office, a person employed there will be assigned accordingly. This person is responsible for the tasks associated with the guardianship.
