The Lower Saxony State Authority for Road Construction and Transport is the responsible planning approval authority for this.

Plan approval and planning permission are regulated in the various federal planning laws (here § 17 of the Federal Trunk Roads Act/FStrG) and the state laws (here § 38 of the NStrG) as well as in the administrative procedure laws of the federal and state governments (VwVfG §§ 72 - 78).

In principle, roads may only be built or modified if the plan has been approved in advance. This means that a planning procedure must be carried out for all major planned construction measures on roads as the basis for subsequent implementation. This also applies to the construction of cycle paths on the relevant roads.

The participation of the public bodies, owners and other affected parties is provided for by law in this administrative act. In a procedure, all public and private interests affected by the construction project are to be weighed up against each other and conflicting interests balanced out.
