Who pays for the funeral?

There is a law in Lower Saxony.
The law is called: BestattG.
The law says:
A funeral (burial) is compulsory.

That means:
Someone has to take care of the burial.
For example:

  • the spouse
  • the life partner
  • the children
  • the grandchildren
  • the parents
  • the grandparents
  • the siblings.

Maybe you don't have enough money for a funeral.
Then you can make an application.
Then you get money for the burial.
The office only pays the important costs for the funeral.

The burial obligation arises from § 8 of the Lower Saxony Law on Mortuary, Burial and Cemetery Services (BestattG).

The burial of the deceased person must be provided for in the following order of priority

  1. the spouse or registered civil partner,
  2. the children,
  3. the grandchildren,
  4. the parents,
  5. grandparents
  6. and the siblings

If it was contractually agreed during the lifetime of the deceased who is to provide for the funeral, this person must provide for the funeral irrespective of the public-law funeral obligation under Section 8 (3) BestattG.

If the persons obliged to bear the funeral costs cannot reasonably be expected to bear the necessary costs, they can apply to have the funeral costs covered.
