The team consists of the Youth Welfare in Criminal Proceedings and the Outpatient Socio-Pedagogical Services for Young Offenders departments.

Youth welfare in criminal proceedings (JuHiS) becomes active whenever it learns that a young person (14 to 17 years) or an adolescent (18 to 20 years) is alleged to have committed a criminal offense. The team provides advice and support during the criminal proceedings and beyond on the legal basis (§38 JGG).

Youth welfare services in criminal proceedings are informed of the proceedings by the justice system (police, public prosecutor's office) and then contact the young person and their family or the adolescent.

During the consultation, it must be checked at an early stage whether youth welfare services are being considered, whether they are already being provided or have been initiated.

Youth welfare services play a central role in the promotion of informal diversion procedures (in accordance with Section 52 SGB VIII) in criminal proceedings. Diversion refers to the possibility of discontinuation at any stage of criminal proceedings against a young person or adolescent. This means that formal court proceedings/judgment are dispensed with.

Accordingly, the youth welfare team in criminal proceedings (JuHiS) reports on the personal circumstances, development and environment of the young person to the public prosecutor's office or the court.

The youth welfare services in criminal proceedings are also responsible for all young people (aged 14 to 18) in the city of Salzgitter in cases of truancy.

Legal basis:

The legal basis is the Child and Youth Welfare Act (SGB VIII) and the Juvenile Courts Act (JGG), the central provisions of which are §52 SGB VIII and §38 JGG. While Section 52 SGB VIII specifies the duties of JuHiS involvement, Section 38 JGG sets out the main rights of youth welfare in the proceedings.

As a result, the judiciary has no authority to issue instructions to youth welfare services in criminal proceedings.

The specialists in the area of "Outpatient Socio-Pedagogical Services" (ASA) carry out supervision instructions (in the sense of educational support and intensive individual socio-pedagogical assistance), social training courses, socio-pedagogically supported work projects and victim-offender mediation.

The ASA also gets involved when young people between the ages of 14 and 18 are fined for truancy and these fines are to be converted into hours of work. In this case, the ASA can help find a suitable place to work, monitor the completion of the hours or, if appropriate, have the fine converted into another suitable measure by resolution (Section 98 OwiG).
