Before you make more detailed plans on how you will build on a plot of land that you have purchased or want to purchase, you should clarify what the associated development plan says.
The qualified development plan sets out in a legally binding manner which buildings and other structures are permitted on a plot of land. Determinations are made, among other things
- the type of building use (e.g. residential, mixed, commercial area),
- the extent of building use (e.g. number of storeys and floor space, height, number of full storeys),
- the construction method (open or closed construction method),
- the buildable plot area
- the local traffic areas.
The simple development plan, which does not meet the requirements of a qualified development plan, only contains individual stipulations as binding regulations and is supplemented by the regulations of the applicable Sections 34 and 35 of the German Building Code (BauGB).
